Organizatat e shoqërisë civile u bëjnë thirrje deputetëve të Partisë Demokratike të Kosovës, konkretisht propozuesit të projektligjit z. Gazmend Bytyqi që të tërheq projektligjin për mbrojtjen e vlerave të luftës së UÇK-së. Ne kemi ndjekur me shqetësim zhvillimet e fundit në lidhje me këtë projektligj dhe besojmë se si i tillë projektligji nuk është në përputhje me të drejtat dhe liritë e përcaktuara në Kushtetutën e Republikës së Kosovës. Veçanërisht, projektligji aktual cenon lirinë e shprehjes, ndërsa minon përpjekjet drejt arritjes së drejtësisë për të gjithë viktimat dhe të mbijetuarit nga të gjitha grupet etnike.

Sipas nenit 40 të Kushtetutës së Republikës së Kosovës, liria e shprehjes është një e drejtë e garantuar dhe përfshin të drejtën e njerëzve për tu shprehur, përhapjen dhe marrjen e informacionit, opinioneve dhe mesazheve të tjera pa ndonjë pengesë. Në nenin 5 të projektligjit për mbrojtjen e vlerave të luftës së UÇK-së, thuhet se “çdo zyrtar publik dhe qytetar i Republikës së Kosovës është i detyruar të respektojë dhe mbrojë vlerat e luftës të përcaktuara me këtë ligj në çdo kohë dhe rrethanë brenda vendit dhe jashtë.” Ky artikull shkel qartë lirinë e shprehjes të garantuar me Kushtetutë dhe si i tillë nuk duhet të pranohet.

Për më tepër, projektligji i propozuar është shumë shqetësues kur merret parasysh diskutimi i përgjithshëm publik dhe implikimet politike rreth rolit dhe trashëgimisë së UÇK-së. Ka pasur një numër rastesh në të kaluarën kur njerëzit janë linçuar kur kanë shprehur publikisht mendimet e tyre për UÇK-në dhe individët që kanë qenë pjesë e UÇK-së. Për më tepër, miratimi i këtij ligji do të krijonte mundësinë për iniciativa të tjera që shkelin këtë të drejtë dhe si i tillë do të krijonte një precedent të rrezikshëm. Prandaj, ne i bëjmë thirrje anëtarëve të parlamentit të jenë vigjilentë dhe të përqendrohen në mbrojtjen e lirisë së shprehjes si një e drejtë bazije e njeriut dhe një vlerë themelore demokratike.

Ne besojmë se përpjekjet tona institucionale dhe kolektive duhet të përqendrohen në paqe dhe pajtim, duke mbështetur dhe respektuar dinjitetin e të gjithë viktimave dhe të mbijetuarve të të gjitha etnive nga lufta e fundit në Kosovë dhe duke kërkuar drejtësi për të gjithë.

Zajednička izjava organizacija civilnog društva o Nacrtu zakona o zaštiti ratnih vrednosti OVK

Organizacije civilnog društva pozivaju poslanike iz Demokratske Stranke Kosova, posebno predlagača nacrta zakona g. Gazmend Bytyqija da povuče Nacrt zakona o zaštiti ratnih vrednosti OVK. Pratimo nedavna dešavanja u vezi sa ovim nacrtom zakona sa velikom zabrinutošću i verujemo da kao takav nacrt zakona nije u skladu sa pravima i slobodama propisane u Ustavu Republike Kosovo. Posebno trenutni nacrt zakona krši slobodu govora, dok podriva napore ka pravdi za sve žrtve i preživjele iz svih etničkih grupa.
Prema članu 40 Ustava Republike Kosovo, sloboda izražavanja je zagarantovano pravo i uključuje pravo ljudi da se izraze, šire i primaju informacije, mišljenja i druge poruke bez ometanja. Član 5 Nacrta zakona o zaštiti ratnih vrednosti OVK kaže da je „svaki javni funkcioner i građanin Republike Kosovo dužan da poštuju i štite ratne vrednosti utvrđene ovim zakonom u bilo koje vreme i u određenim okolnostima. u zemlji i inostranstvu. ” Ovim članom se jasno krši sloboda izražavanja zagarantovana Ustavom i kao takva ne bi trebalo da se primenjuje.
Predloženi nacrt zakona veoma je zabrinjavajući kada se uzme u obzir celokupni javni diskurs i političke implikacije koje se odnose oko uloge i nasljeđa OVK. U prošlosti je bilo više navrata kada su ljudi linčovani zbog javnog izražavanja svojih mišljenje o OVK i pojedincima koji su bili deo OVK. Pored toga, donošenje ovog zakona otvorilo bi vrata za druge inicijative koje krše ovo pravo i predstavilo bi opasan presedan. Stoga pozivamo poslanike parlamenta na budnost i fokusiranje na zaštitu slobode izražavanja kao osnovnog ljudskog prava i temeljne demokratske vrednosti.
Verujemo da bi se naši institucionalni i kolektivni napori trebali usredsrediti na mir i pomirenje, podržavajući i poštujući dostojanstvo svih žrtava i preživelih svih etničkih grupa od poslednjeg rata na Kosovu i zahtevajući pravdu za sve njih.

Joint Statement of the Civil Society Organizations on the Draft-Law on Protection of the KLA War Values

Civil society organizations call on the deputies from the Democratic Party of Kosovo, specifically the proposer of the draft-law Mr. Gazmend Bytyqi to withdraw the Draft-law on the Protection of KLA War Values. We have been following the recent developments regarding this draft-law with great concern and we believe that as such the draft-law is not in line with the rights and freedoms enshrined in the Constitution of the Republic of Kosovo. Particularly the current draft-law violates freedom of speech, while it undermines the efforts toward bringing justice for all victims and survivors from all ethnic backgrounds.

According to Article 40 of the Constitution of the Republic of Kosovo freedom of expression is a guaranteed right and it includes the right of people to express themselves, to disseminate and receive information, opinions and other messages without impediment. Article 5 of the draft-law on the Protection of the KLA War Values, states that “any public official and citizen of the Republic of Kosovo shall be obliged to respect and protect the war values determined by this Law in any time and circumstance within the country and abroad.” This article clearly violates freedom of expression guaranteed with the Constitution and as such should not be enforced.

The proposed draft-law is very concerning when taking into account the overall public discourse and political implications revolving around the role and legacy of the KLA. There have been a number of occasions in the past when people have been lynched for publicly expressing their opinions about the KLA and individuals that have been part of the KLA. Additionally, the passing of this law would open a door for other initiatives that violate this right and as such it would set a dangerous precedent. Therefore, we call on the members of the parliament to be vigilant and focus on protecting freedom of expression as a basic human right and a foundational democratic value.

We believe that our institutional and collective efforts should be focused toward peace and reconciliation, supporting and respecting the dignity of all victims and survivors of all ethnicities from the last war in Kosovo and demanding justice for all of them.
